Default H+S angled bb question

i have had a broblem with the bb pipework rubbing on the inner cv boot ,it sits about 10mm bellow the tie that holds the boot on ,I dont know if its when i go over bumps or what , but it makes contact ,eventually breaking the tie off , it's the third time i have had to refill the boot with grease and put another tie on in under a year, i'v also had to use an extra bungy and stainless steel ties to try and pull the exhaust over to the right to clear the boot ,i'v got the car booked in to have some mod done to the exhaust ,the system is H+S bb H+S centre and ninja downpipe the problem might be because of the ninja downpipe not suited to the H+S.

has anyone else had this problem and if you have the H+S angled bb could you posibly take a pic of where it sits in relation to the cv boot
