I'm not blaming the Spanish legal system for it - it is as it is
Hence, the police have gone through the channels to obtain this warrant and were successful in doing so. The primary concern was with the child who has now been found.
If the child had not been found or was found dead a short time later - you will have been blaming police for the lack of action and not using everything in their power to find him.
There may also be intelligence on their systems and other authorities systems (social services) to suggest the child may be at risk which will only be privy to the police, CPS and courts.
The police knew that they had left the country. Without any warrant issued, would you have been happy that the family were stopped by Spanish police in the their car and the child seemed fine and the parents said there were going to look after him - and off they go.
Since you're bringing other cases into this - Tia Sharpe was reported as missing from home and police were told by her grandmothers boyfriend that he had seen her leaving the house to buy shoes. Should we have just believed the 'family' on this occasion and start searching the shoe shops like we were told. We searched his house, clearly not well enough, as we found her body in the loft after the 4th attempt. So we should have searched his house with a fine tooth comb the first time around, but how would that have looked if she wasn't there. We would have been blamed for 'heavy handedness' and a 'disproportionate response' in victimising the family of the missing girl.
Police are often between a rock and a hard place in situations like this and i'm not a by product of any culture. As i said before, i'd prefer to err on the side of caution when a child's life is at risk.
