so they say that she cannot promote because of her contract with x factor? surely the contract ends when they dont push her forward? but at the end they say they have not stopped her from promoting the single??? strange.

Contract term maybe for the duration of this series, or several years thereafter....if the lawers specifically put a date or duration into that contract, it has to be adhered to, or they'll sue for breach or demand whatever is contained in any clauses of breach.

LOL, that's because choosing to do so would be breach of contract. So yes, it IS her decision not to promote it.
A spokesman said: “We have not banned Gamu from promoting the single.”
LOL, translated again, what they say is the contract probably does not state the word "ban", therefore if the wording doesn't explicitly say ban (a ban by legal definition is something carried on government level, for example, by a judge or politician, not a lawer), then she is not banned from doing so. She can promote it, but its breach of contract and will be liable to whatever is contained in the clauses (for example 80% of proceeds etc). A contractually agreed restriction or clause is not a ban; its an agreement not to do something, in which the agreement is commited by signing it under witness.

I'm fairly good with interpreting legal jargon; Its all about reading between the lines.

Having said that, the actual act of saying she is contractualy obliged not to promote other records outside of X-factor could be considered as promotion, and there is probably a clause in the contact pertaining to it, so she's probably screwed now anyway. May as well go ahead and do it

On the otherhand, it could all be **** and bull conjured up by Gamu's PR manager to create some media stir (anything that gets a headline in the media is good for business), however, such an act maybe considered as defamatory.

She'll be under contract at least until the show ends if not 12 months from when the show ends.

Last year it emerged that the contract they enter into gives a certain management company first refusal on any artist discovered on the show. There was some ruckus over Jedward signing a management contract and who has rights on that contract.

The article is correct, she will be under contract and will be obliged not to promote the single.

What the hell the due process of tort has to do with Parliament is beyond me!
