Hi people,iv just bought a van off a mate,hes just moved house and lost v5.i got it cheap and said id apply for a new log book,save his doing it and i know it will get done if i do it.
Anyway my question is he sorn'd it a while ago,iv just sent log book aplication form off,but do i also need to send a sorn form off aswell or wait untill i get log book then do it?
I dont want to be getting any fines!
Give the DVL peeps a ring tomorrow and ask. If you get through the 26 options they are quite helpful. At a guess they may need something from your mate to show that you haven't just nicked the van
He will certainly have to tell them that he has sold the car to you. There is a part of the log book which is specifically for that use. I imagine that he needs to inform them about the sale to you officially so that they will than send the new log book to you in your name. They may send a replacement logbook to him so that he can then use it to tell them about the sale to you. You have to keep a part of the logbook to prove title until you get the new logbook in your name.
Can't help you about the SORN. I expect they just want the money to tax it.

As you say OP they'll send him a letter saying someone is trying to register his van. If he doesn't reply, you'll get a new V5 in your name.
However, it is the seller's responsibility to send off the V5 so they might try to send him a fine for not doing it. The thing with that is the DVLA is good at losing post so remember, he definately posted it... right? Remember that in case you drop him in it by calling the DVLA.
Regarding SORN if the van isn't taxed then you can't use it. The bit of the V5 you should have taken away would have allowed you to tax it so I suspect you are just goign to have to wait until the new V5 is issued. You need either a reminder or the numbers off the V5 to do it online so that's no help either.

Surely there has always been a necessity to inform DVLA if you transfer ownership of your vehicle to someone else. Bit too easy otherwise if you go about stealing cars!
Its a criminal offence not to notify change of owner. Recently, in the local press, i notice that people regularly get fined for " failing to notify change of ownership".
It was obviously too much trouble for them to send the slip back to DVLA- expensive mistake!

Yes but don't forget the OP has already said the V5 is lost and he is applying for a new one which you can do for any car. I could download a form now and apply for the V5 for your car. That's one of the reasons it says "not proof of ownership" in big letters on the front.
You specifically said his mate would have to tell them he's sold the car. He won't as in this scenario as the DVLA will write to him saying someone is trying to register your vehicle to them and if that's wrong then he would need to contest it. As above, if I tried to re-register your car I'm sure you'd kick up a fuss!
As he's sold the vehicle, then the OP's mate needs to do nothing as he doesn't want to contest the change of registration.
As I also said, the seller now has to inform the DVLA by sending off the V5 if they don't they can be fined.
However, in this instance, that horse has bolted so the advice was to shut the stable door after it had gone.
Again, if the DVLA come knocking to fine the seller he needs to tell them he did post it. They can't prove he didn't so the fine won't stand.

yes,when you fill in the v5 application form you choose one of three options,one being you are a new owner applying for a log book as the original was lost! they now send him a letter and if he doesnt dispute it in 21 days or so they send me the log book!
as its sorn now i had to send a sorn form aswell as the sorn on vehicles doesnt transfur to new owners! so when log book comes through i can insure,then tax and will be away!!!
