It happened around 3pm on golden hillock rd around birmingham. I'm still shook up and still shaking...maybe I'm a wussy:brickwall . Luckily it wasnt my car it was my bosses priced possesion that he loves very much:( .

I was on a single carriage road. Turning left into an industrial estate. I indicated well before 200-300 yards. As I went for the turn I went a little wide and turned.....just in flash a mercedes s-class went straight into me:( (still feeling sick about it) Picture below will show. The obvious question is who's fault? Mind because I went a little wide? I shouldnt think so. Anyways the guy was being a total TIT!

I jumped out while the landy was still start and showed him the indicator was still ticking!!!! He wont admit any liability so this will get dirty eventually.

Good news is: Its all on cctv...and I have 3witnesses:thumb:

But was I still wrong...my fault? I feel sick and guilty that it was my bosses car.

To give you an idea how hard the car hit.....I had a load of autoglym stuff and cloths......they were found 50yrds down the road:eek: :eek:

All I did was turn into my mates place to wash the car....and BANG. I still cant get believe it happened.

What do you think about the damage on the landy? is it a write off? I hope not.

first of all mate, your ok, thats what matters ok. its a car, regardless of ownership/value etc.

im just trying to fathom out how the collision occured. you turned left and then the merc hit you? this isnt any suspicion, im genuinely trying to picture the accident in my mind as something similar happened to me last april.

having read again, was it a case of as you went wide, the merc undertook you on your passenger side?

If he was behind you and you have independant witnesses (CCTV etc.) I'd have thought it'll be his fault 100%. He shouldn't admit anything at the scene at all as thats what the insurance companies advise, so I wouldn't necessarily read anything too sinister into that.

I had almost the exact same thing happen in February, except I was turning right. Only I didn't have any independant witnesses to support me. Even though matey was behind me and didn't see me turning, he tried to claim I was parked up and pulled out and turned right in front of him. :Whatever_

I'm yet to find out if it'll end up being 100% his fault, or 50/50 due to there being no independant witnesses and it just being my word against his.

Unless you were in a right hand lane, and indicating right, he's got no justification for attempting to overtake on the left of you. Classic impatience "accident", and his fault.

As said nobody was squashed but it does shake you up.

I am assuming that the Merc was behind and I'd have a small wager that his mind was elsewhere and he didn't see you signalling until the last minute when the only option he had was to try and squeeze through the inside.

Looks like the Merc came off worse.

The first one is always the worst in terms of thinking "what if" etc.

Don't let it get to your confidence as that is when you will start to be dangerous on the road - nervous drivers are bad drivers.

He was simply following me like a regular car. I turned left...he didnt bother to look and went straight into me. Then blamed the whole plot on me:brickwall

I would guess, that unless the chassis is bent, it'll get fixed, easily.... if the chassis is bent, more than likely a write off....:(

I know what you're going through, many years ago I crashed my Dad's pride and joy, made worse as it was my fault and he was on holiday. You've got the worst bit out of the way - telling your boss.

Sounds then like he almost hit you from behind, wasn't paying attention.

Main thing is that you are feeling terrible now but it will only get better. Tomorrow you will wake up and it will seem like a long time ago, especially as nobody was hurt.

On the pictures you've posted it doesnt look like a write off. obviously without seeing the chasis nobody could say either way. We rally landies and they take a hell of a lot of damage before writting it off, just looks like replace the wing, door and skirt. they may well have to replace the rear tub too...

like others have said mate, your fine and thats the main thing. These things happen everyday.

Playing devils advocate, insurance may well turn round and say that because of that plate the policy is null and void.... unlikely but dont be surprised. If they can get out of paying they will !

is there not an insurance omnbusman (sp?!) which you can appeal to if you feel hard done by on an insurance claim?

Im assuming you swerved right to the centre of the carriage way to give you better access to the *tight* ;) entrance on the left? ...im guessing that the Merc just saw a flashing indicator & you moving to the right & impatience got the better of him, either way it sounds 100% his fault <especially if you were stationary waiting to access the entrance ;) ;) >

Did you get any photographs of the road surface? Skid marks in particular. Although the Merc may not have skidded, when it hit the Landrover that would have skipped sideways a bit, possibly leaving marks on the road to show its exact position. These can always be ignored if not in your favour.

At least your ok, that's the main thing.

From what I can gather, you've came down the road and indicated for your turn off. You must know that it's a fairly tight corner and moved out to the right ever so slightly. Mercedes driver has obviously been somewhere else in his little mind and saw you at the last minute. Only thing he could do was undertake you due to you moving to the right slightly...

Car wouldn't be a right off by the looks of the initial photographs. Chassis would need to be bent, boot floor would need to be crushed and your pillars would need to be damaged enough. Theres more as well but thats the basic bodywork that they'll write it off for.

Suprised you didn't get pulled for the Illegal Show Plates to be honest. Someone was on Police Camera Action with them and got fined.

Have to agree with JFRace - a big vehicle does do this all the time, because people expect it. A short wheel base Landie is not a big vehicle - and has a decent enough turning circle to be able to negotiate a turn. The only reason for swinging out is because the turn is tight and you are thus wanting to take the turn at a higher speed than braking more would allow you to do.

I am sure it is the Merc's fault, but would comment that have a bone to pick with people who are seemingly unable to turn left into a junction without swinging out first to take the turn when it is usually not required. How many times have you gone to overtake (perfectly legally) when someone has done this only for them to pull right (and potentially into you) while looking left to make the turn.
